    I came in on an F1 and got transfered to a H1B without leaving the country.
    My H1 was approved for 3 years ie till 2012.
    Due to problems at my work place, my H1 got revoked by my employer.
    I'm in the medical profession, hence, jobs are few and far between if removed form a training program such as I was in. The next cycle of jobs dont start employment till July 2011.
    I am currently within the 180 day limit.
    What are my options? My countrys consulate is known to be tight fisted with visas, especially as I have overstayed since I lost my job abruptly.
    If my fiance and I do get married, am I eligible for for adjustment of status?

    Please help!

    When Senate Majority Leader Harry Reid picked up his ball and went home after his staged all-night session last week, he saved from possible embarrassment one of the least regular members of his Democratic caucus: Sen. Ben Nelson of Nebraska. Reform Republican Tom Coburn had ready an amendment to the defense authorization bill removing Nelson's earmark funding a Nebraska-based company whose officials include Nelson's son. Such an effort became impossible when Reid pulled the bill.

    That Reid's action had this effect was mere coincidence. He knew that Sen. Carl Levin's amendment to the defense bill mandating a troop withdrawal from Iraq would fall short of the 60 votes needed to cut off debate, and Reid planned from the start to pull the bill after the all-night session, designed to satisfy antiwar zealots, was completed. But Reid is also working behind the scenes with House Speaker Nancy Pelosi to undermine earmark transparency and prevent open debate on spending proposals such as Nelson's.

    These antics fit the continuing decline of the Senate, including an unwritten rules change requiring 60 votes to pass any meaningful bill. When I arrived on Capitol Hill 50 years ago, Majority Leader Lyndon Johnson (like Reid today) had a slim Democratic majority and faced a Republican president, but he was not burdened with the 60-vote rule. While Johnson did use chicanery, Reid resorts to brute force that shatters the Senate's facade of civilized discourse. Reid is plotting to strip anti-earmark transparency from the final version of ethics legislation passed by the Senate and House, with tacit support from Republican senators and the GOP leadership.

    At stake is the fate of Coburn's "Reid amendment," previously passed by the Senate and so called because it would bar earmarks benefiting a senator's family members such as Reid's four lobbyist sons and son-in-law. Nelson's current $7.5 million earmark for software helps 21st Century Systems Inc. (21CSI), which employs the senator's son, Patrick Nelson, as its marketing director. The company gets 80 percent of its funds from federal grants, mostly through earmarks. With nine offices scattered among states represented by appropriators in Congress, the company has in recent years spent $1.1 million to lobby Congress and $160,000 in congressional campaign contributions. "As of April," the Omaha World-Herald reported, "only one piece of [the company's] software has been used -- to help guard a single Marine camp in Iraq -- and it was no longer in use."

    In requesting the 21CSI earmark, Nelson did not disclose his son's employment. "There's no requirement that he disclose that," a Nelson spokesman told this column. "But frankly, in this case, we didn't disclose it because it's so public." An April 24 letter from Levin giving senators instructions on how to request an earmark made no mention of the "Reid amendment" that had been passed by the Senate three months earlier but that required only certification that no senator's spouse would benefit from an earmark. Inclusion of Nelson's son, however, would be required if the ethics bill provision passes.

    When the defense authorization bill came up last week, Coburn prepared amendments to eliminate the Nelson earmark and the most notorious earmark pending in Congress: Democratic Rep. John Murtha's proposed $23 million for the National Drug Intelligence Center in his Pennsylvania district. Reid's plan to satisfy antiwar activists with an all-night debate averted debate, for now, on those two earmarks.

    Reid, the soft-spoken trial lawyer from Searchlight, Nev., has tended to suppress free expression in the World's Greatest Deliberative Body in his tumultuous 6 1/2 months as majority leader. Last week, he cut off an attempt by Sen. Arlen Specter, the veteran moderate Republican, to respond to him with an abruptness that I had not witnessed in a half-century of Senate watching. When Specter finally got the floor, he declared: "Nothing is done here until the majority leader decides to exercise his power to keep the Senate in all night on a meaningless, insulting session. . . . Last night's performance made us the laughingstock of the world." It may get worse if plans to eviscerate ethics legislation are pursued.

    I am a july 2nd filer , still waiting for EAD for my spouse .I have got mine a week ago,but her case status has no change. When we call 1-800-375-5283 it says there is no information for this case, however we are able to check the case status online, which says received on October 15, and its still pending.

    Another issue is they did not honor the received date.

    Is there any one in similar situation?

    What can we do at this point? Will Infopass appointment or contacting ombudsman help?

    Today, I heard back from a senator and a congressman from New Jersey regarding the webfaxes that I had sent them. Here are a few things that I learnt


    The associate in the Senator's office was not aware of this issue and the one in the congressman was only partially aware of it. If this is the situation of the associates who look after immigration with the lawmakers in NJ, where there are thousands of EB-GC aspirants, the situation might much worse in other states.
    The associates in the lawmaker's office do take the effort to read through the faxes, thus making it effective to bring our issues to their attention.
    Our WebFax application is working fine. Previously I never got replies to my web faxes. What might have helped is the fact that the web fax did have my complete contact information. This makes it more trustworthy in their eyes.


    So I request all of you to send out WebFaxes to your lawmakers. It is free for you and takes only a couple of minutes. Once you have sent it, urge your friends also to do the same.

    Stand up and be heard.

    I have been on q job with a client since October. The setup is like this. Me->my employer->Vendor-.Client.

    The work order my employer has states that my work with the client ends June end, with a possibility of extension. if i file my h1b now, will i be a good candidate for rejection , considering that I do not have a long term project? Also, how true is it that the USCIS is giving visas out only for 1 year under such circumstances, as opposed to the regular 3 years term, and if true, how do I avoid it

    Lastly, what is your take on how H1 filings on Apr 1 2010 will be? Is it expected to the same as last year, or will companies file left right and center on day 1 itself?

But in a seeming effort to show the Democrats are close to ready to go on immigration reform, Senators Reid, Schumer and Menendez began circulating a detailed outline of a comprehensive immigration reform bill that appears to exclude Senator Graham.     Even I got my TX DL renewed for 6 more years 2-3 months ago and that too on internet. Texas is a real liberal state! Michigan sucks.

    Hi,

    I hold a H1B Visa from Company A, which is valid until Sep 2010. I have not used this Visa since the stamping is done.

    I am working in India from an X Company and because of the recession and bad job market at US, I did not make use of my H1B Visa.

    But now my Employer (Company A) has an in-house project in US. So, I am planning to enter US on my H1B Visa now.

    1) What documentation is required to show at the Port of Entry?
    2) Since my Visa is going to expire by Sept 2010, which is just 6 months validity, will there be any issues / queries at the Port of Entry.

    All,

    I'm a EB2 filer and PD is 2003. We did a concurrent filing on Jul 2nd, received receipt notices for the same, FP Completed and EAD approved.

    I see the A NUMBER printed on my 140 and 485 receipt notices. I wanted to understand whether the 'A' number mentioned on the receipt notices is the VISA number or, the VISA number is something different that gets assigned during the adjudication of I485 based on the availability.

    Trying to assess the impact of EB2 retrogression on cases that are already filed and Finger printing is complete.

    Please Advise.

    My law firm applied my EAD/AP/485 on Aug 13th. I got my Receipt Notices for all three.
    My question is where does USCIS send the FP Notice and EAD?
    Do they send it to my house address or lawyer?

    WASHINGTON (Reuters) - Deepening unhappiness with President George W. Bush and the U.S. Congress soured the mood of Americans and sent Bush's approval rating to another record low this month, according to a Reuters/Zogby poll released on Wednesday.

    The Reuters/Zogby Index, which measures the mood of the country, also fell from 98.8 to 96 -- the second consecutive month it has dropped. The number of Americans who believe the country is on the wrong track jumped four points to 66 percent.

    Bush's job approval rating fell to 24 percent from last month's record low for a Zogby poll of 29 percent. A paltry 11 percent gave Congress a positive grade, tying last month's record low.

    "There is a real question among Americans now about how relevant this government is to them," pollster John Zogby said. "They tell us they want action on health care, education, the war and immigration, but they don't believe they are going to get it."

    The dismal assessment of the Republican president and the Democratic-controlled Congress follows another month of inconclusive political battles over a future path in Iraq and the recent Bush veto of an expansion of the program providing insurance for poor children.

    The bleak mood could present problems for both parties heading into the November 2008 election campaign, Zogby said.

    "Voter turnout could still be high next year, but the mood has turned against incumbents and into a 'throw the bums out' mindset," Zogby said.

    The national telephone survey of 991 likely voters, conducted October 10 through October 14, found barely one-quarter of Americans, or 26 percent, believe the country is headed in the right direction.

    The poll found declining confidence in U.S. economic and foreign policy. About 18 percent gave positive marks to foreign policy, down from 24 percent, and 26 percent rated economic policy positively, down from 30 percent.

    A majority of Americans still rate their personal financial situation as excellent or good, although the number dipped slightly this month to 54 percent from 56 percent. In August, 59 percent rated their finances as excellent or good.

    "Americans are still feeling good about a number of things in their lives, but not about the government's leadership," Zogby said. "They are giving up on this government."

    The Index, which made its debut last month, combines responses to 10 questions on Americans' views about their leaders, the direction of the country and their future. Index polling began in July, and that month's results provide the benchmark score of 100.

    A score above 100 indicates the public mood has improved since July. A score below 100 shows the mood has soured, and a falling score like the one recorded this month shows the nation's mood is getting worse.

    The RZI is released the third Wednesday of each month.

    In the 2008 White House race, Sen. Hillary Clinton of New York tightened her grip on the top spot in the Democratic nomination race with the support of 46 percent, up from 35 percent last month.

    Her top rival, Sen. Barack Obama of Illinois, was at 25 percent, moving up slightly from last month's 21 percent. Former Sen. John Edwards of North Carolina was third with 9 percent, and about 12 percent of Democratic voters were unsure of their choice.

    Among Republicans, former New York Mayor Rudy Giuliani expanded his lead over Fred Thompson, the former senator and Hollywood actor. Giuliani led Thompson 28 percent to 20 percent, compared to last month's 26 percent to 24 percent.

    Former Massachusetts Gov. Mitt Romney jumped from 7 percent to 14 percent and moved past Arizona Sen. John McCain into third place. McCain fell from 13 percent last month to 8 percent.

    More Republicans, 18 percent, said they had not made up their mind, leaving room for more shifts in the field. "We still have one in five Republicans undecided. That race is really up in the air," Zogby said.

    A majority of voters asked about former Vice President Al Gore said he should not run for the White House in 2008 despite winning the Nobel Peace Prize. About 51 percent said he should not enter the race and 40 percent said he should.

    The Nobel award on Friday came halfway through the polling period. The Gore question was asked of 485 likely voters with a margin of error of plus or minus 4.5 percent.

    The rest of the national survey had a margin of error of plus or minus 3.2 percentage points.

    No, you only pay the visa application fees. India has a visa agreement with US so issuance fee is no longer required. You should check the US consulate website for more details.

    Hi:

    My In-laws applied for visitor visa on 26th May at Delhi US Embassy. One of them got the passport from VFS after getting VISA for 10 years but other one is still waiting. I am in US on H1B visa with my family.

    We called VFS and they said they did not get the passport back from US Embassy.
    One of my in-law works for Indian government as scientific assistant with food dept.

    It seems right now there is no way we can track what processing is going on?

    Is there any such cases known in the past and what could be the reason for the delay in the passport arrival from US Embassy? Do they perform additional verifications and what time it takes usually?

    Any clues/suggestions?
