Hello,
I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

I want to change my employer from A to B. B has filled for h1b transfer on 26-sept-2007 (I have fedex tracking number). Till today (9-oct-2007) we hv not received the receipt notice.
My expected start date was 1-oct which has been extended twice, i.e 8th & then 15th. If receipt does not come will 15th, then can I join the new employer?
Is there any way I can find out the file position/status using fedex tracking number?
Can new employer file one more application for h1 transfer under premium process?

I currently reside in Nebraska. I'm in pending I-485, and its I-797C�s Received Date was in Aug, 20007, Receipt Number: LIN-xx-xxx-xxxxx. My EAD expires on this December 2010, and my AP has expired on December 2008. I re-entered US on Feb, 2010 using H1B Visa and its HIB has expired on May 2010. I�d like renew my EAD and AP. I�ve got all paper ready to file, but I�m confused about Where Service Center/Office I should file to and pay the fees to. I�d appreciate your help.

My I 140 approved under Eb3 if i want to change my job and my employer is willing to do in EB2 can I use my old PD from I140 EB3 ?

Now my question is since most of the UK universities offer MS for 14-15 months, can I quailify for EB2 Categoy?

First check if the check you or your company sent for H-1 fees got cashed , if so see behind the check ( normally banks post scanned copy of check ) the Receipt number will be written behind the check ..hope this helps

Can I apply for EAD for spouse on the basis of I-140 approval? I can not file I-485 due to retrogression and he is running out of her H1B visa limit.

My h1-b is expiring in decemeber, i applied for renewal 4 months back but it is stuck in security check. I can apply for 485 as my 140 is approved.
1. if i apply for 485, then EAD can also go thur sec check?
2. after 240 days if EAD is not available what are my options?
3. I am planing to get married but cant bring wife on h4 as my h1 is not current, what are my options? if my 485 get approved or i use my EAD i wouldnt be able to bring her?

Does anyone know if EAD renewal requires an employment at the time of renewal? My I140 have been approved and I485 pending for long time under EB2-NIW. Also, do I loose legal status to stay in USA if I lost employment while my I485 pending. Again, my GC application is not company sponsored, it was all by myself. Do I stay in right status even I become unemployed while my I485 pending. My I485 will be pending for few more years due to retrogession. So I am wondering if I can stay as unemployed for a period of time while my AOS pending.
Also, do I need to have an employment while re-entering using AP? I recently used my EP to re-enter but no question was asked about employment. I am thinking if I can use AP for re-entry if I travel outside while I am unemployed. I have to think about all this options as chaotic situation is going on the company and layoff might be inevitable.
