Hi: Need some inputs from the excperts in this group on using the priority dates from a different I140 filing.
Have the following 2 cases filed for the same person.
PD - Nov 2004 - EB3 - Labor Approved - I140 Filed
PD - Oct/Nov 2005 - EB2 - Labor Approved - I140 Approved
If we file I485 based on the I140 approved for EB2 case [which has a later PD], can we still send an update to USCIS later regarding Nov 2005 PD and use that PD once the I140 from the EB3 filing is approved? What's the best way to use the highest EB category and oldest PD in this case?

Can I travle outside US after applying for conversion. Need some one to response ASAP
If you travel out of the U.S. while an application for change of status is pending the USCIS will deny the pending change of status application.

Dear all:
May I ask what I should do in the following situation?
I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

I got this mail today saying the pledge failed to meet its target of 100 people. Only 88 signed up for the pledge :mad:
I think we need to start another drive as we have more members now and we are very close to the lame duck session. Any suggestions???

If your 'temp stay' implies staying in a hotel and flying to Chicago on the weekend then no. If it means that you have leased an apartment and plan to stay in NY for a few months then sure go ahead and fill it out.

Have valid EAD [me and wife] but never used it. Still on H1B and H4 respectively.
I am on second term H1B which expires on Oct-2010.
Project is ending and I have to find new job. Current company applied for EAD renewel last week. But didn't want to spend for H1B renewal since I might change jobs. I am planning to invoke AC21 and shift to similar job. I want to know what is the last date for me to renew/port my H1B ?
My wife used her Advance Parole for travel [but did not use EAD for job], does that mean she is not in H4 anymore ?
Thank you friends. Any advise would be appreciated.

Hi,
My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.
In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?
I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

Hello All,
The officer at the SSN issuing center told me since my passport and the stamped I-94 have my maiden I will get an SSN also in the maiden name and not my married name.
However I had already filed for my EAD (form I-765) before getting this information with my married name which I need to change to the maiden name. I have received an appointment letter for biometrics/finger printing (FP) . What should be done now? Should I wait and tell the officer during the FP about this name change that I need or how should I go about it?

Hi Gurus,
If you look at my signature, My 485 has been transferred to TSC from NSC and AP is still stuck at NSC. I have some emergent situation back home , I have faxed the doctor certificate and called USCIS using POJ method and the guy says it might take another month. wat the *****....tried infopass..my local office doesnt have no more appointments.
My questions:
1. Can I take Infopass appointment anywhere else which is not my local office?
2. Can I apply a new 131 application at TSC as my 485 is there now?
Someone pls advise.

If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?

However, my current lawyer emailed me this morning saying that you can transfer your PD, but not in the same category (EB2). In other words, to keep my PD, I will have to apply through EB1 or EB3 with my new employer. I had not heard of this before and was wondering if this is a true statement. Has anyone successfully transfered their PD within the same category? Thanks.
