Hi All,
I have already moved to AC21 with one of the big firm and now I am planning to move to Small Company. My job duties will remain same and salary will be greater than my labor filled wages. Questions I have are,
1.Does it matter size of new company in terms of money or number employee for continuing my GC process ?.
2. In case of RFE, Will there be question on Ability to Pay on new small company?

I applied for my AP in June and recently at the end of August my AP was approved. I received the AP a couple of weeks later in mail. However I noticed that instead of receiving the I-512 Authorization of Parole of an Alien into the United States, I received an I-797C Notice of Action document for me an my wife. The contents of this I-797C are exactly the same as the previous I-512s that I have filed for and received over the years.
What I am afraid of is that this may cause problem at the port of entry when I return back from India because of the wrong title of the document.
Has anyone else received such a a document I-797C instead of I-512 and is it safe to travel having such a document? Any advice/input is appreciated.

I am sure with this whole fiasco something good will turn up. It might take long but it will be for betterment of us all. I am proud to be an IV member and fully commend their ongoing efforts.

I am married with an American Citizen. His petition has been approved. My problem is that I cant change my status because my J1 visa was subject to the 2 years home country. I came as an Au Pair or Child Care Provider in 2007. I have been subject to that rule because the Skill List from 1997, which is not even in any field in my country El Salvador in the Skill List. That is why my application is hereby denied.
I dont know what i should do, because just I have 15 days to make a motions to reopen o pay a waiver and re-file my application all over again.
Please I need help is anyone can advice me in this. I really need it.

I got my EAD last October (filed for my I-485 on July 02, '07) but did not apply for my AP then;
Now I need to apply for my EAD renewal and am also thinking of getting an AP. Do I need to get an AP for the current year (that is for the time period from Oct '07 to Oc 08) and then apply for AP extension or can I directly apply for AP for Oct '08 to Oct '09?
the second option will save me money and so for me that is the preferred one :D
any information on this is much appreciated,

The ridiculous amount of time DOL is spending on the Perm Audits in just incomprehensible. They still approved 1 may be 2 application a day, thats my assumption. Last time I saw they are still processing audited-applications filed in Aug/Sept 2007.
Any word on how what their plan is? They really do have bunch inefficient people working for government!!!

I'm new at this forum and am hoping someone would be able to shed some light on my dilemma. My labor certification is currently under supervised recruitment. I checked the America's Job Bank website and found my ad, but the job description in it contained only the part according to O*Net occupation description. The form ETA-750 had some additional job requirements posted by the employer, which were omitted in the AJB ad. I'm afraid with the current ad at AJB they'll get tons of applications.
Can someone advice what shall I do?

Hi
I and my wife want to start business ( daycare/pre school) and want to know below details.We both have Green card.
1) Do I need to open LLC or INC for this ?
2) I have home loan so will I get business loan for new property.

Labor category has little to do with AC21. Your responsibilties should be 'similar', which is kind of a vague term, which means USCIS would generally not mess with anything that has enough of the same words used in description.

Hi,
I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question?

My I 485 receipt does not have a priority date. Is it common to have an I 485 without a priority date.
