Kudos to USCIS though for keeping themselves employed. They have made such a mess of what could be a simple immigration planning process, by introducing layers upon layers of groupings, arbitrary allocation number limits and what not. A similar but perhaps even more complicated rocket science mess exists in another govt entity - the IRS.

Ooops, i missed this in my original post. This is true for Nebraska service centre.
I am not sure about the other service centre. Sorry dudes.
This is great first step! Many more to cross over! :) . Think about the USPS or other carrier who will be delivering these tons of letters.. I hope the mountain of receipts will not be a overwhelming factor for them.

Have all those visas made available been used up so far by USCIS? I doubt it.

It depends on how visa number requested is used in the I-485 approval and how it is termed as "used" from "made available".

I give a lot of credit go USCIS for giving me all type of emotions that no other organization has given like fear, frustration, anger, anxiety, sadness . The only one missing is happiness.

I am sorry for posting in here, but I was wondering if someone actually went in person to the Houston Consulate to get their passport renewed. Also, do we need to have any reason to attend in person at the Consulate such as emergency, etc.
    ....

It is better to appear in person because of the two reasons:
    1. Avoid any chances of losing/delaying the mail.
    2. If any extra document is needed, you will come to know right away and you can ask your questions/doubts at the same time.

I went in person to the SFO Office and got my passport next day.

As EB1 is Cureent, presume processing applications up date, EB3 is Unavailable, means no work to do for USCIS people as far as EB3 Adjudicate cases, leave EB4, EB5 categories aside which dont have many applications to process. Then the only category left for working with is EB2 and that also having ROW being current, the adjuticate applications left for processing with available visa numbers are EB2 India for time being. So this means for the next few months including this June 2008 there might be many approvals in EB2 India category, as because theres no considerable work in EB category for USCIS people except EB2 India Adjudication. So presumably all the available visa numbers will be processed effectively in the EB2 category for the fical year.

I think u r right. We shouldn't think abt our future in this country and nor abt the people who were in backlog as we r the one's who suffered the most.Y we have to suffer because of mis-communication between DOS n USCIS.If they will be taking our reaction in negative way let them. If they want to revive CIR(Legal immigration-point system) , let them do. If they do, the same as British did , let them. Let see our present, don't worry about future. If they think to throw us back to our home country ,the right they have , let them do. But i just want to say is that- if they made an inquiry over this issue, not only they'll hold all backlog cases that r approved now but also they will stop issuing new visa numbers till this is resolved-result -delaying the process more. It will definetely take time. The thing is atleast backlog is cleared now, so the process will move smoothly. But anyway lets fight for injustice done to us.Lets don't wait for oct opening. We want now!!!
For last 2 weeks of June , we worked hard and delivered our application on 2nd july. Lets Do IT GUYS!!!!!:)

    EB-3;PD-March'2004

My brothers in blood, please calm down Mahatma Gandhi had his own way of fighting for freedom and so did Subhash Chandra Bose. They must have agreed and disagreed with each other on many things. But at the end of day, their motive was the same Justice and Freedom.

We might have our differences, our opinions and ways of doing things, but we need to understand that our motive is the same. We should stop bickering with each other and concentrate on the main goal. We should keep encouraging our members to join hands and unite and fight for the cause.

Though you might not agree with each other, you still need to see how severely the issue must have affected the other person which is why they are here and ready to fight.

Please pull your swords to fight the injustice rather than fight with each other.

    PEACE!

Is it true that when we apply for NRI home loan we should repay the loan back in foreign currency.
If that is the case what will a person do if he applies for the NRI loan( long term) and moves back to India for good after few years .Will he have to pay back the loan in foreign currency before making the move?

    Thank you.

I checked with IV core and few attorneys regarding this issue. You will need the consent of the employer since we are dealing with I-140 petition. Please speak to your HR and try convincing them to support you. We are not asking USCIS to expedite our cases. All we are asking is follow the FIFO and process cases in an orderly manner.

    vparam/ anyone,

    i have 2 questions

when i move into my own LLC how far do I need to go in terms of documents/ pay-stubs to prove to the USCIS that it's a legitimate company/ job offer? i guess i am a bit confused as to how to present to USCIS my dual role as owner/ employee with 140 job description?

also from your experiences is it practical (in terms of taxation) to just run your own payroll (from consulting) through your LLC - meaning you are the only employee in your company?

    thanks in advance,
    manderson

    -----------------------------------------------------------------------------------
Ref (Murthy): " Foreign nationals can port their cases to a self-employed position! This is a very favorable stance, as many foreign nationals desire to establish their own companies and, in that way, control their own destinies. The entrepreneurial spirit is strong among many immigrants. The Memo reiterates the need to show that the new position or job is the same or similar. It also states that the new employer and job offer must be legitimate.
    MurthyDotCom
In these situations, the USCIS is to focus upon whether the original job offer was really the intended employment at the time the I-140 and I-485 were filed. That is, the petitioning company must have intended to employ the foreign national beneficiary and the foreign national beneficiary must have intended to accept the position at the time of filing the I-140 and the I-485."
    Source: http://www.murthy.com/news/n_yatmay.html
I think the 2nd paragraph means USCIS might want additional RFEs from your 140 employer later on to prove that original 140 employment offer was valid.

From the above paragraph (quoted on Murthy site), it seems that it would be very much possible to just get self-employed (of course job description should be same and legal).

    But here are the Questions:
1). How will USCIS be convinced that the original job offer was really the intended employment at the time the I-140 and I-485 were filed??
2). How do you prove to USCIS that the original job offer was something that you intended to take on getting your GC?

From the below excerpt (same Murthy site and part of above doc)

Ability of New Sponsor to Pay
    m
The Memo clarifies that there should not be requests for "ability to pay" proof from the new sponsor as part of the I-140 approval process. However, the Memo does state that it would be appropriate to check the legitimacy of the new employer and the job offer in connection with the I-485 approval. So, the new employer may have to show financial viability and prove that there is a valid job offer in order for the foreign national employee and any family members to obtain the I-485 approval.

    Questions:
3).Doesnt the above mean that USCIS will still check to see if your (lets say) spouses company or start-up company has the ability to pay you?

4). So, even though USCIS is saying Yes to self employment, will they (excerpt from mandersons musings)
..ask for 2 yrs of tax filings of future employer to prove that it's an established company (although they are not supposed to bring up 'ability to pay' issue which is already covered in approved 140 -- but being USCIS anything goes...)???

The priority date based on the person first entering/start wrking for US on H1B visa, or converting to a H1 status from any other visa status in the US is an excellent one. This is good idea and fair deal to everyone which in turn follows FIFO method.

Did you ever hear the proverb "quitters never win" and winners never quit.

Quit here go to Canada and then face some problems there and then quit canada. And then you will become the rolling stone which gathers no mass. Your family will be sick of your shifting then and no stabilization will cause more issues.

A friend of mine told me this one evening when I was really frustrated and was planning to quit my dream on being an entrepreneur and here I am now, and I think where I am right now is for the reason that I didn't quit that day and finally my product was liked by a company and they bought the product and offered me a job as well and then one thing lead to another and now I am settled with what I always wanted to do ( kinda not 100%) but its ok.

Instead of ruining our life running after GC, here are few options

    1) if you really want to live in a developed country, move to Canada or Australia. their process is much simpler and faster
    2) cash out your investments and move to India. you might end up back in US on L1 :)
    3) since some of us have had babies here, wait till they can sponsor you.

i have personally done 2 of the above. I have a Canadian PR and i have established contacts in India in case i need a job there. What am i doing here? saving as much money as i can, and waiting for the right opportunity in Canada or India. GC can kiss my ......., i got better things to do in life.

I see that most of the people who initially responded to my first post about the southern california state chapters have some recent activity i.e. they have visited this website in the last 2 days after my last posting requesting you to e-mail me about your availability for a conference call today. Not one of you has responded to my request to e-mail me.

I just want to make you all aware that IV core members can do a limited amount of work. They are definitely not superhumans although we expect them to be as such. If we fail in our efforts to secure any retrogression relief we will have only ourselves to blame in such a situation. Besides this is a very ripe time to be active and talk to politicians here in Southern California region. I would like to reschedule the conference call for the coming week/weekend depending on your availability.

In the end our best intentions and best wishes are not going to get us the immigration relief we want. We also cannot blame IV core team if we do not start working and lending them a hand. The choice is clearly ours. I hope that all of us will be more forthcoming and open to spending some time on IV work in the future.

    Regards

    Amit
Thanks Jimi for the note and being proactive. It is sad that nobody responded to your call despite sevaral members in this thread that signed up. If we dont take active interest and do nothing, we can only blame ourselves iif nothing happens in DC soon enough. IV is not IV core but each and every member of IV and efforts are needed from each member in order to succeed. Jimi, pls send PMs to all members on the thread requesting them to get in touch with you so that you can organize state chapter activites.

When you have these news articles ready...one of the easiest way to circulate them is using a news wire agency.

I have used http://www.prweb.com/ before for my company news releases. It is free and if you want a broader reach pay $80. It is very effective.

It is a good idea to release it when something related to immigration is going on in senate or house. During this time, all major news network pickup articles from these wires based on keywords like "immigration, border issue etc"

So make sure you add appropriate keywords when you do the release.

Still per my attorney it shows "In-Process". Mine was filed on Feb 5th...

Visa Bulletin suggests that severe cut-off date retrogressions are likely to occur early in FY 2008, which starts on October 1, 2007.

So we still have some time on our side.
