I need something which removes employer dependency with approved i140 until u file 485.
I hate working at the same employer just becasue my PD is not current. And by the time my PD becomes current, may be employer is not doing good, I am not happy at the job.... and I have to start from PERM again at new employer. Also if employer revokes i140, I loose the PD as well!!

You don't loose your PD if I-140 is revoked. All you need is an approved I-140. USCIS does honor the PD from a revoked I-140. That is what I have heard from various immigration attorneys. The PD is yours to keep. I think USCIS is generous enough to not push a person out of the queue once you have started your GC and progressed until I-140 approval.
I agree, I am definitely breathing from the July'07 filing. Otherwise it would be worse for me and my family to be working for my first GC employer. I am on your side for that.
A general advice don't stress yourself too much about it. It is definitely not good for your health. I use to check the status on my case every single day during my I-140 stage and got stressed out a lot and eventually earned some health problems from which I am slowly recovering. This is just a friendly advice.

I agree with you regarding the timeline and evidence. I have mentioned it to my attorney numerous times. My attorney was insistent that adjudicating officers can see all my info on their computer screens. It is only a matter of looking at the info correctly.
It looks like the first MTR went to the same IO who denied my I-485. I could say it from ID in both the denial letters.
Sometimes lawyers are used to their old ways of doing things. However, IOs are not the same people of the old. Most IOs are new hires and still in their learning curve.

I filed my EB2 with the same employer. Did not get any RFE for PERM Labor. I have M.S degree from US. I am in the same job role from the beginning (Web Developer).

If let us say 20,000 visas were unallocated in 2007 and USCIS realized that on the 28th of September, 2007, they still wont be able to use up those 20,000 visas. Because the priority dates were pushed back so far that there probably isn't that many applications that have completed the fingerprinting and name check stage. So, we have another reason to believe that USCIS may not be able to use up all the visa numbers just because of the priority dates (even if they worked throughout the weekend).
So it makes sense "now" to put the cut off dates a little conservatively because USCIS has already received those applications. They should be allowed to approve them according to the visa number availability and the case status in a first come first serve basis (considering the receipt and priority dates).

Yeah, my lawyer said once my LC approves he'll file I-140/I-485 together? I'm EB2 Sri Lanka
You should discuss the risks involved in concurrent filing with your lawyer too. In some circumstances if I140 is likely to face hurdles, you should wait for your I140 approval. This is just a caution. Each case is different.

I happen to be a freelance writer (not a journalist). In response to this thread, I have penned a 2,700 word commentary on the current challenges titled "The Plight of Promise". In order to beef it up with some compelling statistics, can 5 or 6 people respond to this thread with anonymized details of their specific circumstances and how they are suffering. This is aboslutly not possible; he/she is trying to fool every one. Before retrogression, the last date to file a 485 for a EB3-Indian with PD 08/2004 was 12/31/2004. From Jan 2005 till July 2007 EB3 Inida was retrogressed for his PD. So he/she could not apply 485 in Feb 2005. The other optins could be he/she may be in EB2 catagory or a Schulde A nurse.
I was in similar time frame; So I know the date well....

It is true that a lot of the members signed up just so that they can follow the happenings, and maybe post an immediate question that they might have. We may have a huge membership base, but without any action from such a base can make any plan from the core a failure. What we need to do is to energize the baselevel members. The senate is comprised of senators from our respective states, and the house has reps from each state. We have individual state chapeters for IV. I think the Core will need to plan out a strategy to help the state chapters approach their senators and house reps, while the core concentrates on contacting the DoJ committees. Meeting a few senators here and there will not help. We need to contact ALL the senators and apprise them of the situations. Rather than have a different message sent to each senator, the core will need to define an agenda, and the communication needed. The state chapters will need to take that and follow up with their respective senators and reps, without diluting any of the messages. Having the core meet all the senators is not proper, we need to pitch in too. Unless we work as a team, nothing that the core has planned will work.
I was/am a member in immigration.com where all the talk of starting this forum happened. I have interacted with the core on many occassions before, and I was also one of the first to join this community. But work and family pressures prompted me to stay away, and in the meantime, my handle and password were forgotten. I had to resign up, and what I find today is that there is no understanding between the members. Be thankful that this forum was set up, and contribute positively in any way you can. Without your support, the core cant do it all. Lets stop worring about donations and membership fees. We are all intelligent, and highly paid. We have the brains to talk to senators and house reps. Lets move forward to get at least piecemeal legislations passed. Lets not wait for CIR. CIR is not going to happen, so dont believe in it.

So, they want us to create an awareness and buyin from decision Makers.
"Therefore, without legislative relief, the waiting time for Indian EB2 applicants may be measured in years, even decades."
I agree. This was always there and it is only now that the government has acknowledged it. Mr. Oppenheim has given us ammunition to build our case and we must use it wisely.
Maybe we can have a have a "send fax" feature on IV from where we can quote Mr. Oppenheim's statement to send a fax to our senators. Also, it is high time that IV is a paid site even if it is $1 per month or 1 cents a day i.e. $3 per month. As I suggested in the past, new members/ visitors should be allowed to read the forums but to post a question or reply to a question one should be a paid member. I am confident that even with $1/month of 1 cent/day we will do better collections that we are doing now.
